About the FISD Sample
Contract Text
FISD assembled an
international group of contract professionals representing the exchange, vendor
and user segments of the market data industry. The first step was to aggregate
the model exchange contracts of the vendors into a single document. That draft
was evaluated by a wide range of exchanges in North America and Europe culminating
with a series of concept discussions on the objectives and specific intent of
exchange contract language.
Based on
those discussions, the Contracts Working Group developed this sample contract
text. This document should be viewed as draft language on a comprehensive list
of market data issues and viable policy options as an aid to negotiation. It also
shows how policies and guidelines that have been adopted by FISD members may be
incorporated in exchange agreements.
This
sample text is intended for use in conjunction with the FISD Exchange Contract
Guide. Where possible, the sample text reflects a consensus view. Parts on square
brackets are either:

of policies where there is no current consensus or
- to
be used only if specific conditions are fulfilled or
- to
be adapted according to the circumstances or
- to
be completed where in blank.
